These Terms of Service ("Terms") govern your access to and use of the websites, APIs, SDKs, NTRIP streams and positioning services (collectively, the "Services") provided by AGPS India ("AGPS India", "we", "us" or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for any activity that occurs under your account or credentials, and for keeping your access keys, tokens and NTRIP credentials confidential.
2. Accounts & Access
- You must provide accurate and complete information when requesting access.
- You are responsible for safeguarding credentials and for all use of your account.
- We may suspend or revoke access for misuse, non-payment, or breach of these Terms.
3. Acceptable Use
You agree not to:
- Resell, sublicense or redistribute the Services without prior written consent.
- Reverse engineer, interfere with, or disrupt the integrity or performance of the Services.
- Exceed agreed usage quotas or attempt to circumvent rate limits and security controls.
- Use the Services for any unlawful, harmful or fraudulent purpose.
4. Service Availability
We strive to provide reliable, low-latency positioning with high availability. However, the Services are provided on an "as available" basis. Coverage, accuracy and latency may vary based on location, device, environment, satellite visibility and network conditions. Any service-level commitments will be set out in a separate written agreement.
5. Accuracy Disclaimer
Positioning data, including AGPS assistance, RTK corrections and Cell ID estimates, is provided to assist your applications and should not be relied upon as the sole source for safety-critical decisions. You are responsible for validating suitability for your specific use case.
6. Fees & Payment
Where the Services are offered on a paid basis, fees, billing cycles and quotas will be described in your plan or order. Fees are non-refundable except as required by law or expressly agreed in writing.
7. Intellectual Property
All rights, title and interest in the Services, including software, APIs, documentation, trademarks and the AGPS India logo, remain the property of AGPS India or its licensors. These Terms do not grant you any ownership rights.
8. Limitation of Liability
To the maximum extent permitted by law, AGPS India shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill arising from your use of, or inability to use, the Services.
9. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Services or other users. Provisions that by their nature should survive termination will continue to apply.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
